"The Credit Card Accountability Responsibility and Disclosure Act" otherwise known as The CARD Act of 2009 will bring many changes for credit card users, from stricter rules on when credit card companies can charge a late fee to getting tougher on credit applications. Following are some effects of the law consumers can expect to see in the near future.
Student Credit Cards
Perhaps the biggest change will be in the college student credit card. Until recently, college students were a favorite target of credit card companies that barraged first year students with applications as soon as they set foot on campus, much to the chagrin of parents who were often saddled with the high fees and interest payments their kids couldn't meet. Now credit card applicants under 21 will have to provide proof of income and ability to pay or have an adult co-sign for the card.
Credit Card APR, Late Fees, and Credit Limit
The best news for credit card users is probably the regulations dealing with late fees, interest rates, and increased credit limits. Some of the highlights are:
- Promotional rates must last at least 6 months and interest rates cannot be increased within the first twelve months of card ownership.
- After 1 year, interest rates can be raised with 45 days notice, but the new rate will apply only to new transactions and cannot be applied to an existing balance unless the cardholder is more than 60 days overdue on payments.
- Credit card bills must go out 21 days before the due date thus allowing more time before late fees are applied, and any payments received by 5:00 PM on the due date must be credited without a late fee.
- Over limit fees are prohibited unless the cardholder elects to have the credit limit increased for over-limit transactions. In other words, credit card companies may not automatically increase the credit limit when a purchase exceeds that limit unless the cardholder requests them to do so.
In addition, the CARD Act requires credit card issuers to disclose on their statements the total interest amount and the time it will take to pay off the current balance when making only the minimum payment each month.
